Current voluminous data collection by all kinds of organization creates the need for rights of action beyond or in complement traditional damages. This research considers the possibility of using an old equitable remedy – the constructive trust – to remedy from ongoing privacy invasions and disparate impacts of personal data collection, storage, and use.

Jasmine E. McNealy is an attorney, critical public interest technologist, and social science researcher who studies media & technology with a view toward influencing law and policy. Her research focuses on privacy, surveillance, and data governance within the context of emerging media/technology. 

She is an associate professor at the University of Florida (on sabbatical leave 2022-2023), a technology advisor at the Federal Trade Commission, a Visiting Fellow at the Shorenstein Center on on Media, Politics & Public Policy at the Harvard University Kennedy School, and a Faculty Associate at the Berkman Klein Center for Internet & Society at Harvard University. She is also the founder and principal of The Alveary LLC. 

She earned a PhD in mass communication and a JD at the University of Florida, a M.Ed in Measurement, Evaluation, Statistics & Assessment at the University of Illinois-Chicago, and a BS in both Journalism and Afro-American Studies at the University of Wisconsin.
